Brad Bell Real Estate (Real Estate Buyers.com.au A.C.N. 115 728 768) respects your right to privacy. We are bound by the National Privacy Principles contained in the Privacy Amendment (Private Sector) Act 2000. Those principles regulate how we collect, store and use and disclose information about you and other individuals.

Collection, Use and Disclosure

In our agency business, we collect, hold, use and disclose to third parties, personal information for a number of reasons:

  • To carry out appointments as sales agents for clients selling their policy;
  • to carry out appointments as property managers for rental property owners, which includes processing tenancy applications and managing tenancy relationships and the tenanted property;
  • to complete documents in relation to the sale or rental of properties (eg contracts of sale, tenancy agreements and any other documents required including those required by law). it may also be necessary to disclose your information to third parties in relation to such transaction (e.g. building and pest inspectors, valuers, solicitors, maintenance contractors and others).
  • To promote and market our services and the products and services of third parties (we will only use your personal information for this purpose and not to disclose it to third parties);
  • To reply to enquiries and information requests made by individuals;
  • For internal business processes such as market research and billing; and
  • As TICA may collect personal information about you, the following information about TICA is provided in accordance with the National Privacy Principles in the in the Privacy Act 1988. TICA Defaults Tenancy Control Pty Ltd (A.B.N. 84 087 400 379) is a tenancy database that records tenants personal information from its members including tenancy application inquiries and tenancy history. In accordance with the National Privacy Principles you are entitled to have access to any personal information that we hold on any of our databases. To obtain your information from TICA, proof of identity will be required and can be made by any of the following ways: Phone 1902 220 346 calls are charged at $5.45 per minute including GST (higher from mobile or pay phone) Mail: TICA Public Enquiries PO BOX 120, CONCORD NSW 2137 a fee $14.30 plus stamped self addressed envelope is required envelope is required. Primary Purpose, TICA collects information from its members on tenancy related matters and provides such information to other members as a risk management system for the purpose of assessing a tenancy application. TICA does not provide any information that it collects to any other individual or organisation or any other purpose than assessing a tenancy application or risk management system other than government departments and or agencies allowed by law to obtain information from TICA. The personal information that TICA may hold is as follows: Name, date of birth, drivers licence number, proof of age card number and or passport number (except Australian), comments made by a TICA member in relation to your tenancy, which members you rented through and which members you applied to;
  • where required by law.

We collect personal information about individuals:

  • from the individuals themselves - through the application forms, registration books open inspections, appointment forms, registration books at open inspections, appointment forms, agreements, correspondence including emails, our website and through verbal communications;
  • From third parties (including from other agents, from operators of tenancy reference databases and other publicly available databases and from referees and employers) - in the course of verifying and evaluating tenancy applications and managing tenancy arrangements, and in carrying out agency services for a client, including through property services.

Direct Marketing

From time to time, we use information supplied to us by Commercial Database Companies for marketing purposes. Prospective Clients and Customers are given the opportunity to be excluded from these activities and can elect not to receive marketing material from us. However, where a third party distributor, such as a pamphlet distributor has been contracted, we cannot be held responsible for marketing material delivered to an address that has previously elected not to receive such material. We recommend the use of a 'No Junk Mail' sign on your letterbox in these instances.

Security of Information

We will take all reasonable steps to ensure that the personal information we hold about you is not subject to loss, misuse or unauthorised access or alteration. We will also take reasonable steps to destroy or de-identify personal information if it is no longer required.

Access to Personal Information

If you would like to access or correct any personal information we hold about you, please do not hesitate to contact us. Please note that a charge may apply to cover all reasonable costs that we may incur in providing you with access to your personal information.

We will take all reasonable steps to correct any information which you show to be inaccurate, incomplete or out-of-date.
